Why are car accident victims required to prove their injuries are permanent but not motorcycle accident victims?
The Florida No-Fault law requires car
drivers to carry at least $10,000 in personal injury protection
insurance coverage, also called PIP. While this insurance pays
for certain medical bills it does not cover many other types of
damages, such as compensation for disfigurement, pain and
suffering, and loss of capacity to enjoy life. The PIP law
specifically states that to be eligible to recover these damages
from the person at fault the injured person must prove that the
injuries are permanent. However, since motorcycle riders are not
required to carry PIP insurance, if they are injured in a
motorcycle accident they do not have to prove their injuries are
permanent in order to recover for these types of damages. |
